1. Acceptance of Terms

By accessing or using ColorFlowPro ("the Service"), available at www.colorflowpro.com and app.colorflowpro.com, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

ColorFlowPro reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

ColorFlowPro is an AI-powered brand kit generator that creates brand identities including color palettes, typography pairings, brand voice guidelines, logo concepts, and brand guidelines documents. The Service is provided on a freemium model with free and paid subscription tiers.

3. User Accounts

To access certain features, you must create an account through our authentication provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must be at least 16 years of age to create an account.

ColorFlowPro may suspend or terminate your account if you violate these Terms or if your account is inactive for an extended period, with reasonable notice where possible.

4. Payments and Subscriptions

Paid subscriptions (Creator, Studio) are billed monthly through our payment processor, PayPal. By subscribing to a paid plan, you authorize ColorFlowPro to charge your selected payment method on a recurring monthly basis.

Prices are listed in US dollars and are subject to change with 30 days' advance notice. Price changes do not affect the current billing cycle.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Unused brand kit generations do not roll over between billing periods.

5. Usage and Acceptable Use

Each subscription tier includes a monthly limit on brand kit generations (Free: 1, Creator: 5, Studio: 20). Usage resets at the start of each billing cycle.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the underlying AI models
• Use automated scripts, bots, or scrapers to access the Service
• Resell access to the Service without written authorization
• Generate content that is hateful, defamatory, or promotes violence
• Circumvent or attempt to circumvent usage limits or security measures

6. Intellectual Property

Your Content

You retain all rights to the brand kits, color palettes, typography selections, brand voice content, logo concepts, and other assets generated through the Service using your inputs. You are free to use generated content for any commercial or personal purpose without additional licensing from ColorFlowPro.

Our Content

The ColorFlowPro name, logo, website design, software, and underlying technology are the intellectual property of ColorFlowPro. You may not copy, modify, or distribute our proprietary technology, branding, or marketing materials without written permission.

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. ColorFlowPro does not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by applicable law, ColorFlowPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

ColorFlowPro's total liability for any claim arising from these Terms shall not exceed the amount you paid to ColorFlowPro in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless ColorFlowPro, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

9. Termination

ColorFlowPro may terminate or suspend your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately, but you retain ownership of any brand kits generated prior to termination.

10. Modifications to the Service

ColorFlowPro reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice for material changes. We are not liable for any modification, suspension, or discontinuation of the Service.

11. Third-Party Services

The Service integrates with third-party providers including Clerk (authentication), PayPal (payments), OpenAI (AI generation), and Google Analytics (analytics). Your use of these third-party services is subject to their respective terms and privacy policies. ColorFlowPro is not responsible for the practices of third-party services.

12. Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant ColorFlowPro a non-exclusive, royalty-free, perpetual, and irrevocable right to use, modify, and incorporate that feedback into the Service without obligation to you.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal resolution.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ColorFlowPro regarding the use of the Service, and supersede all prior agreements and understandings.
